Terms of Service

1. Scope

These Terms of Service (“Terms”) govern the use of the Cadruno website (cadruno.com) and application (app.cadruno.com) operated by Maximilian Gürke, Oberdorf 31, 99947 Bad Langensalza, Germany (“Cadruno”, “we”).

By creating an account or using paid features, you agree to these Terms. Deviating terms of the user apply only if we confirm them in writing.

2. Service description

Cadruno provides software tools to analyse property investments: calculations, scenarios, labelled data origins, and related decision-support features.

Cadruno is a decision aid only. Cadruno does not provide investment advice, tax advice, legal advice, or energy advice. Interest rates shown are estimates, never binding loan terms or offers. Outputs are not a substitute for advice from licensed professionals (tax advisor, lawyer, bank, appraiser).

3. No tax advice

Cadruno is not a tax advisor and does not provide Steuerberatung within the meaning of German professional law. Any figures, labels, scenarios, or explanations that touch on taxes (for example real estate transfer tax inputs, depreciation themes, or holding-period ideas) are general information and decision-support only. They are not binding assessments, filings, or recommendations for your individual case.

Cadruno does not file taxes, prepare returns, determine your personal tax rate or residency, or guarantee that a displayed percentage matches the rate applicable to your municipality or transaction structure. Always consult a qualified tax advisor (Steuerberater) or the competent tax office before acquisition, holding, disposal, structuring, or filing. Cadruno accepts no liability for tax disadvantages arising from reliance on platform outputs.

4. Eligibility and account

You must be at least 18 years old and capable of entering into binding contracts. You must provide accurate registration data and keep login credentials confidential. You are responsible for activity under your account.

5. Plans, prices, and VAT

A free tier may be offered with usage limits. Paid plans and one-off credit products are displayed before purchase. Prices are shown as indicated at checkout.

Unless stated otherwise, prices are net plus applicable VAT. Invoices may show German VAT under the UStG; our VAT ID is DE450354418 (§ 27a UStG). Stripe Tax or equivalent mechanisms may apply for EU VAT compliance.

Subscriptions renew for the agreed period unless cancelled in time via the billing portal or account settings. Statutory consumer cancellation rights, where applicable, remain unaffected.

6. Acceptable use

You may use Cadruno only for lawful purposes and in line with these Terms. You must not misuse the service, attempt unauthorised access, overload infrastructure, scrape in violation of robots.txt or applicable law, or submit unlawful content.

Listing data may be imported only from sources that Cadruno permits and only where legally allowed. Cadruno does not circumvent technical access barriers.

7. User content and inputs

You retain rights in data you enter. You grant Cadruno a non-exclusive licence to process that data solely to provide and improve the service. You warrant that you are entitled to submit the data and that doing so does not infringe third-party rights.

8. Intellectual property

The Cadruno software, branding, layouts, and documentation remain our property or that of our licensors. No licence is granted beyond what is needed to use the service as offered.

9. Availability

We aim for high availability but do not guarantee uninterrupted operation. Maintenance, force majeure, and third-party outages (hosting, payment, AI providers) may cause downtime. AI modules run only via the configured model access; if access fails, affected outputs show an error instead of a silent substitute calculation.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For slight negligence, we are liable only for breach of essential contractual obligations (cardinal duties), limited to the foreseeable damage typical for this type of contract. Liability for lost profits, missed investment opportunities, or incorrect financing or tax decisions based on Cadruno outputs is excluded to the extent permitted by law.

Cadruno calculations depend on your inputs, third-party listing data, and models. You remain solely responsible for verifying numbers before any purchase, financing, or tax filing.

11. Indemnity

You will indemnify Cadruno against claims arising from your unlawful use of the service or from data you submit, unless Cadruno is responsible for the claim.

12. Term and termination

You may stop using Cadruno and delete your account at any time. We may suspend or terminate access for material breach of these Terms, abuse, or legal requirements. Paid periods already paid are handled according to the plan terms and mandatory consumer law.

13. Changes

We may update these Terms for legal, technical, or business reasons. We will notify registered users of material changes in an appropriate form. Continued use after the effective date constitutes acceptance, unless mandatory law requires a different procedure.

14. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected.

If you are a merchant, a legal entity under public law, or a special fund under public law, the courts of Bad Langensalza / the competent courts for our place of business have jurisdiction.

If any provision is invalid, the remaining provisions remain in force.
